New Version and Instructions for I-9 Forms

The U.S. Citizenship and Immigration Services released a new version of and instructions for Form I-9 on July 17. The form can be downloaded here. Employers must begin using this form by September 18, 2017. Employers who do not do so may be subject to a penalty, and penalties for Form I-9 violations were increased last year by the Immigration and Customs Enforcement.

The core of the form has not changed and the revisions are minor. The changes include employment eligibility documents in List C, Section 2. An option for a Consular Report of Birth Abroad, or Form FS-240, is now available. This form is given to certain employees that are born overseas to a parent who is a U.S. citizen. Form FS-240 can also now be selected by E-Verify users. Further, List C, Section 2 combines all versions of the certification of report of birth issued by the Department of State, including the FS-545, the DS -1350, the FS-240. The new version also renumbers all List C documents except the Social Security Card.
