New Form I-9 Must Be Used Starting November 1, 2023

As you are aware, federal law requires that every employer who recruits, refers for a fee, or hires an individual for employment in the U.S. must complete Form I-9, Employment Eligibility Verification. 

On August 1, 2023, the U.S. Citizenship and Immigration Services (USCIS) released a revised version of the Form I-9, Employment Eligibility Verification, which may be used now but must be used for all new hires and rehires starting November 1, 2023.  The form can be found here:  https://www.uscis.gov/sites/default/files/document/forms/i-9.pdf?mc_cid=a5dd5a2c81&mc_eid=8711e2d2d4

After October 31, 2023, the prior version of Form I-9 will be obsolete and no longer valid for use.  Starting November 1, 2023, employers who fail to use the August 1, 2023 edition of Form I-9 may be subject to all applicable penalties under section 274A of the INA, 8 U.S.C. 1324a, as enforced by U.S. Immigration and Customs Enforcement (ICE).
