EEO-1 Collection Portal is Open with Reporting Changes

As you may be aware, private employers with at least 100 employees must complete and file an EEO-1 Report that organizes employee demographic data by employee job category, as well as gender and race/ethnicity, and submit that data to the Equal Employment Opportunity Commission (“EEOC”) and the U.S. Department of Labor on an annual basis.  As a reminder, the collection opened on May 20, 2025 and the deadline for employers to file the 2024 EEO-1 Component 1 report is June 24, 2025. 

Note that the EEOC eliminated the option to include nonbinary employees in EEO-1 reports this year. The updated 2024 EEO-1 Component 1 Data Collection Instruction Booklet provides: “The EEO-1 Component 1 data collection provides only binary options (i.e., male or female) for reporting employee counts by sex, job category, and race or ethnicity.”  The change reflects a recent mandate in President Trump Administration’s Executive Order on gender ideology (Executive Order 14168, issued on January 20, 2025), which requires that male and female are the only two recognized sexes.

The EEOC uses the workforce demographic data collected for a variety of purposes including enforcement, analytics and research, and evaluation of industry trends.  Employers should be gathering workforce data in preparation of the upcoming deadline.
